Vaping Legal Countries
The legislature decided not to ban menthol cigarettes after realizing how much tax revenue the state would lose. The governor signed the taste ban and an increased tax on vaping products, but vetoed the attached nicotine content limit of 20 mg/ml, which is not intended to be a final legal guide for traveling vapers. If you are visiting an unknown country, you should first contact an up-to-date official source such as the Ministry of Foreign Affairs of your country or the travel agency of the country you are visiting. The FDA has the federal authority to regulate vaping products. In September 2020, the agency began reviewing pre-market tobacco applications (MTADs) and signaled that it would not allow flavoured products without exceptional evidence. Whether the agency will succeed in creating an unwritten standard that eliminates legal flavored products (other than tobacco and menthol) can be decided by federal courts. There are more than 40 countries that have some sort of vaping ban – whether for possession and use, sale or import, or a combination. What we`ve tried to do here is list the taste and online sales bans of U.S. states, as well as the sales and use bans imposed in other countries. These are the countries where it is acceptable to vape.
Please note, however, that these countries may still have restrictions where you can vape, for example in bars, public places, etc. So check local laws. A good rule of thumb is to assume that where smoking is prohibited, vaping is likely to be too. Jamaica Legal to Use, Illegally Sell Nicotine-Containing Products Without a Medical License In the United States, the Food and Drug Administration (FDA) classifies e-cigarettes and other ENDS as tobacco products. They are legal to use and sell, but the sale of products manufactured after August 8, 2016 is prohibited without a marketing warrant from the FDA. In 2022, products from the pre-2016 period that have not received marketing authorisation will also be withdrawn from the market. As of August 8, 2016, all U.S. states follow the same uniform federal guidelines. Using the US legally, selling legally – but selling products that are not approved by the FDA became technically illegal as of September 9, 2021. While no state has completely banned the sale of vaping products, many have banned flavored products or online sales. Some California cities, including San Francisco, have legally banned the sale of all e-cigarettes in Malaysia, illegally selling nicotine-containing products.
Although the sale of nicotine-containing products by consumers is illegal, Malaysia has a thriving vaping market. Authorities sometimes raid retailers and confiscate products.
