Legal Department Cayman Islands
Despite the severe difficulties caused by the Covid-19 pandemic, the Cayman Islands remains a stable offshore legal market, particularly known for its huge pool of investment funds. As of December 2020, there were 24,591 regulated funds, up from 10,857 the previous year, according to statistics from the Cayman Islands Monetary Authority. This represents almost half of the world`s assets under management. The Cayman Islands are a British Overseas Territory. The legal system is based on English common law as amended by national law, with the Privy Council in London being the highest court of appeal. The legal structures, concepts and approach are immediately recognizable by any consultant in English, American or other law. This backbone of legal similarity and political stability has proven crucial to the islands` growth. The privilege applies to legal advice generally as well as communications made in the context of a dispute. However, there are exceptions. For example, a corporation`s legal advice to shareholders is not normally preferred.
Documents created for fraudulent purposes are never privileged. This is called the rule of injustice. In addition, if the matters arising from the proceedings are particularly sensitive or confidential, the court may order that the court file not be accessible to either a party or any other person, unless the court has previously authorized it. In particular, the amendment gives the Great Court the power to set aside erroneous fiduciary decisions, thereby codifying the “Hastings Bass Rule” (on the validity of a trustee exercising discretion in judgments) in the version in force prior to the UK Supreme Court`s decision in Futter/Pitt v HMRC [2013] UKSC 26. It is therefore not necessary to prove that the trustee breached the breach of trust in the decision.
