Legal Definition of Ears
Foreign person. Any natural person who does not have lawful permanent residence in the United States, a citizen of the United States, or another protected person as defined in 8 U.S.C. 1324b(a)(3). It also includes any corporation, business association, partnership, trust, corporation, or other entity or group not incorporated or organized in the United States to do business in the United States, as well as international organizations, foreign governments, and any agency or subdivision of a foreign government (e.g., a diplomatic mission). “Foreign person” is synonymous with “alien” as used in the EAR and “foreign person” as used in the International Traffic in Arms Regulations (22 CFR 120.16). This definition does not apply to Part 760 of the AEOI (Restrictive Business Practices or Boycotts). Hardware. These are all raw or processed substances specified in the list that cannot be clearly identified as one of the types of objects defined in § 72.1 under the defined terms “final product”, “component”, “accessories”, “accessories”, “part”, “software”, “system”, “equipment” or “installations”. This definition of “transfer” does not apply to section 750.10 of the AEOI or Supplement No. 8 to Part 760 of the AEOI. The term “transfer” may also be included in licenses issued by BIS. In this regard, the amendments that may be made to a BIS licence are the intangible amendments described in section 750.7(c) of the EAR. Any other unauthorized modification of a BIS license is a violation of the AEOI.
