In Hennepin County, Minnesota, data collected between 2016 and 2018 showed how the extent of representation (full, limited, or non-existent) affects a variety of outcomes for tenants in eviction cases. In all dimensions of the study, tenants with full or limited representation performed better than unrepresented tenants.52 Fully represented tenants won 21% of their cases, while those with limited representation won 24% of cases and unrepresented tenants only 11% of cases. Fifty-two percent of fully represented tenants stayed in their apartment, compared to 48% of tenants with limited representation and only 31% of unrepresented tenants. Similarly, 78% of fully represented tenants left court without an eviction application in their cases, compared to only 17% of tenants with limited representation and 6% of unrepresented tenants did so. In particular, the study also concluded that represented tenants are four times less likely to enter homeless shelters than unrepresented tenants. The city hired a coordinator for its new Office of Tenant Legal Services, which began accepting requests for legal representation from tenants in eviction cases in early June.72 To date, the city has allocated $400,000 to the new initiative and is seeking additional funding. Eligible claimants are referred to a pro bono lawyer or legal service provider who enters into a contract with the city.73 According to a New York Times analysis, New York City landlords have used evictions — including frivolous eviction proceedings such as misrepresentation that a tenant did not live in their apartment — to convert affordable rental housing into commercial housing. 27 In one New York borough, between 2009 and 2016, two-thirds of formerly rent-stabilized rental apartments were deregulated by landlords who practiced such practices. The right to counsel is different from eviction prevention services, which some tenants receive from the Legal Services Corporation (LSC), the national agency that funds civil legal aid programs36 to provide services to more than 1.7 million low-income people nationwide.37 Established by Congress in 1974, The LSC is an independent, not-for-profit agency that receives the majority of its funding from Congress.38 Eligibility for LTC services is limited to clients with incomes of $125 or less. While housing issues are the second most important area of LSC case services, housing issues in general – and evictions in particular – are only one of many areas of law that LSC fellows seek to cover with their limited resources.39 The nature and duration of LSC services vary from holding self-help workshops, from ad hoc legal advice and assistance in completing paperwork, to representing clients in court.40 Washington LawHelp provides detailed information on the laws governing tenancy in Washington State. Although the Sixth Amendment to the U.S. Constitution grants defendants the right to be represented by counsel,35 litigants in civil cases do not have the same guarantee of legal representation – even when something as important as their home is at stake. Under New York City`s Right to Attorneys Act (RTC), the DSS/HRA`s Bureau of Criminal Justice (OCJ) offers tenants facing eviction through a housing court administrative proceeding or NYCHA administrative proceeding access to free legal representation and advice from nonprofit legal advisory organizations in all five boroughs.

Evictions also disproportionately affect communities and perpetuate economic inequalities. In response to the growing eviction crisis, and recognizing the effectiveness of guaranteed legal advice, some local governments have offered solutions to tenants who just want a chance not to sue for eviction. The following section discusses some notable examples of approaches to a lawyer`s right that significantly address the eviction crisis and its consequences.
